Terms & Conditions

Last updated: 20 June 2026

1. About These Terms

These terms and conditions govern the provision of landscaping, construction, and related services by PJR Landscaping & Design (ABN registered, Newport VIC 3015). By accepting a quote or engaging our services, you agree to these terms. If you have any questions, contact us before work commences.

2. Quotations

All quotes are provided in writing and are valid for 30 days from the date of issue unless otherwise stated. A quote is an estimate based on the information available at the time of inspection. It is not a fixed-price contract unless explicitly stated as such.

Variations to the agreed scope of works will be quoted separately and require written approval before any additional work proceeds. Changes to materials, site conditions, or client-requested alterations may affect the final cost.

3. Acceptance and Deposit

Work commences upon written acceptance of the quote and receipt of a deposit as specified in the quote document. The deposit is non-refundable if you cancel after materials have been ordered or work has commenced.

Acceptance of a quote constitutes agreement to these terms in full.

4. Payment Terms

Payment terms are as specified in your quote or invoice. Progress payments may be required for larger projects at agreed milestones. Final payment is due on completion of works unless otherwise agreed in writing.

Overdue invoices may incur interest at a rate of 2% per month on the outstanding balance. We reserve the right to suspend works if payments are not made in accordance with the agreed schedule.

5. Scope of Works and Variations

The scope of works is defined in the written quote. Any changes to the scope requested by the client, or required due to unforeseen site conditions, will be treated as a variation. Variations will be quoted in writing and require written approval before additional work proceeds.

Unforeseen site conditions include, but are not limited to: underground services, rock, contaminated soil, poor drainage, or structural issues not visible at the time of quoting.

6. Site Access and Client Responsibilities

The client is responsible for ensuring safe and unobstructed access to the site on agreed work days. Any delays caused by restricted access, failure to obtain necessary permits, or incomplete client-side preparation may result in additional charges.

The client is responsible for identifying and marking the location of any underground services (gas, water, electrical, telecommunications) prior to commencement of any excavation works. PJR Landscaping & Design accepts no liability for damage to unmarked services.

7. Permits and Approvals

Where council permits or building approvals are required, it is the client's responsibility to obtain these unless otherwise agreed in writing. Work will not commence on any element requiring a permit until the relevant approval is provided.

8. Materials

We endeavour to source materials as specified in the quote. Where a specified material is unavailable, we will advise the client and propose a suitable alternative of equivalent or greater quality. Approval of the alternative is required before proceeding.

Natural stone, timber, and other organic materials may exhibit natural variation in colour, grain, and texture. This is not a defect.

9. Workmanship Warranty

PJR Landscaping & Design warrants that all work will be carried out in a proper and workmanlike manner in accordance with relevant Australian Standards and Victorian building regulations.

Where a defect in workmanship is identified within 12 months of practical completion, we will rectify the defect at no charge, provided the defect is reported in writing within that period and has not been caused by misuse, neglect, third-party interference, or normal wear and tear. This warranty does not apply to plant material, turf, or living elements, which are subject to environmental conditions beyond our control.

10. Liability

PJR Landscaping & Design carries public liability insurance. To the extent permitted by law, our liability is limited to the value of the services provided under the relevant quote.

We are not liable for indirect or consequential losses, including loss of use of outdoor spaces, loss of income, or damage caused by events outside our reasonable control (including weather, acts of God, or supply chain disruptions).

11. Cancellation

If you wish to cancel an accepted quote, you must notify us in writing as soon as possible. Any costs already incurred (including materials ordered, labour scheduled, or subcontractors engaged) will be charged to the client. The deposit will be retained to offset these costs.

12. Disputes

In the event of a dispute, both parties agree to attempt resolution in good faith before pursuing formal proceedings. These terms are governed by the laws of Victoria, Australia. Any disputes that cannot be resolved informally will be subject to the jurisdiction of the Victorian courts.

13. Privacy

The collection and use of your personal information is governed by our Privacy Policy.
